Tomco Incorporated
warrants its new Automotive Replacement products that retail for more than
$15.00 United States
currency to be free of defects in material or workmanship.
Tomco
Incorporated does not warrant products which have been (a) modified or altered
outside factory specifications, (b) subjected to conditions such as misuse,
neglect, accident, improper installation or adjustment, dirt or other
contaminants, water or corrosion, gum or varnish, use of improper or poor
quality fuel or fuel additives, improper fuel pressure and faulty repair, or
(c) used in other than those automotive applications listed on this
website. Further, there are no
warranties which extend beyond those stated here.
This
warranty is extended to the original consumer for a duration of 90 days from
the date of original purchase by such consumer.
Any implied warranty determined to be applicable is limited in duration
to the duration of this warranty. Some
states do not allow limitations on how long an implied warranty lasts, so the
above limitation may not apply to you.
In the
event of a defect in material or workmanship, Tomco Incorporated's sole
responsibility is to repair or replace the defective product. Final warranty determination will be the
decision of Tomco Incorporated.
THE FOREGOING WARRANTY IS IN LIEU OF
ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE
IMPLIED WARRANTIES OF MARKETABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE AMOUNTS TO BE PAID TO TOMCO INCORPORATED
FOR ITS PRODUCTS DO NOT INCLUDE ANY ASSUMPTION OF RISK AND TOMCO INCORPORATED
WILL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE FOR ECONOMIC, INCIDENTAL,
CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES OR LOST
PROFITS, WHETHER FORESEEABLE OR UNFORESEEABLE, WHETHER CLAIMED UNDER CONTRACT,
TORT, BREACH, FAILURE OF WARRANTY OR ANY OTHER LEGAL THEORY. SOME STATES DO NOT ALLOW THE EXCLUSION OR
LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR
EXCLUSION MAY NOT APPLY TO YOU.
Examples of
damages not recoverable are actual or alleged labor, vehicle down time,
transportation or other incidental charges.
Warranty
performance will be initiated by the customer contacting Tomco Incorporated's
Customer Service Department with the original dated purchase invoice number for
a Return Goods Authorization (RGA). It
will be the sole responsibility of the customer to ship alleged defective
part(s) to Tomco Incorporated at the customer's expense. Tomco Incorporated assumes no responsibility
for parts lost in transit from the customer shipping point to the warranty
receiving station.
This
warranty gives you specific legal rights, and you may have other rights which
vary from state to state.
This
General Limited Warranty supersedes all prior warranty statements. Inquiries concerning this warranty should be

Shipping Policy
Tomco Incorporated will ship products via United Parcel
Service (UPS) to the contiguous 48 States and Canada. Street address, city, state and zip code are
required as orders cannot be shipped to post office box addresses. Orders to be shipped by UPS ground the same
day must be placed before 1:30 PM Central Time Monday through Friday.
2nd day and overnight shipment orders must be
placed before 1:30 PM Central Time Monday through Friday.
International customers and customers living in Hawaii and Alaska please contact

Method of Payment
Tomco Incorporated accepts VISA and MasterCard for method of
payment. Credit card orders will be
subject to credit approval and verification before order is processed.
Sales Tax
Tomco Incorporated is required to collect sales tax on all
orders shipped to customers in Missouri.
